CALIFORNIA TRANSPARENCY IN SUPPLY CHAINS ACT, UK MODERN SLAVERY ACT STATEMENT

Masimo Corporation and its subsidiaries are dedicated to complying with the California Transparency in Supply Chains Act of 2010 and the UK Modern Slavery Act of 2015. This notice summarizes Masimo's initiatives to eliminate the risk of slavery and human trafficking in Masimo's supply chain. This document serves as our disclosure for Masimo Corporation and its subsidiaries for the fiscal year ended December 30, 2023 and was approved by the board of directors on October 21, 2021.

Organization

Masimo Corporation is a global medical technology company that develops, manufactures, and markets a variety of noninvasive and minimally invasive patient monitoring technologies, hospital automation solutions, home monitoring devices, ventilation solutions, and consumer products, with operations in North America, Europe, Latin America, the Middle East, Asia, and Australia.  Masimo is committed to improving patient outcomes, reducing the cost of care, and taking noninvasive monitoring to new sites and applications.

Due Diligence and Verification

Masimo prohibits any form of forced labor, including slavery and human trafficking, in its supply chain. Masimo evaluates its product component suppliers through questionnaires and risk-based assessments. Verification is not conducted by a third party.

Supplier Audits

Masimo evaluates its product component suppliers for compliance with company standards prohibiting human trafficking and slavery in supply chains through questionnaires and risk-based assessments. Verification is not made by an independent, unannounced audit.

Certification

Masimo’s supplier agreements and purchase order terms and conditions require suppliers to comply with all applicable laws and regulations. Currently, we do not separately require suppliers to certify that materials incorporated into their products comply with the laws regarding slavery and human trafficking of the countries in which they are doing business.

Internal Accountability

Masimo requires all employees, directors, officers, and consultants to comply with our Code of Business Conduct and Ethics, which prohibits any form of forced labor, including slavery and human trafficking, in the supply chain. Masimo maintains a compliance program and requires employees to certify compliance with the Code, investigates potential violations of the Code and other company policies, and takes disciplinary action when necessary.

Training

Masimo’s supply chain management and staff receive training on mitigating the risks of forced labor in the supply chain and applicable company procedures.
